When Should Parents Request an IEE?

Key Rights Protected by IDEA

  • Right to Request: You have the right to request an IEE at public expense if you disagree with the school district's evaluation.
  • District Must Respond: The school district must either agree to pay for the IEE or file for a due process hearing to defend their evaluation.
  • Cannot Delay Unreasonably: The district cannot delay or avoid responding to your request. They must act "without unnecessary delay."

What Happens After You Request an IEE?

The district has two options:

  • Option 1: Agree to fund the IEE at their expense. They will provide you with criteria for the evaluator and may provide a list of approved evaluators (though you are not required to choose from their list if the evaluator meets their criteria).
  • Option 2: File for a due process hearing to prove their evaluation was appropriate. This is rare because it requires legal proceedings. If they win the hearing, you can still get an IEE but must pay for it yourself.

Important: The district cannot simply deny your request or make you wait indefinitely. They must take one of these two actions.
